The Department has announced that by the end of 2023, the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (subclass 186) visa will be available for all Temporary Skill Shortage (TSS) visa holders who have an employer willing to sponsor them for permanent residency. So those in occupations on the short term list will be eligible for PR.
Applicants will need to continue to work in the occupation nominated for their TSS visa(s). Eligibility for the TRT stream will be reduced from three years to two years employment with the sponsoring employer. Applicants will need to meet all other nomination and visa requirements for the TRT stream of the Employer Nomination Scheme visa.
To transition you will need to show two years with the employer on a 482 or a bridging visa granted between 482 visas. You will need IELTS scores of 6 in each band (or the equivalent in another test) unless you are exempt. There must be an ongoing offer of employment for two years from the date of the grant on the 186 visa. Neither party is obligated to fulfill the two years but the offer must be there.
We do not yet have a commencement date but as soon as the legislation is changed if you satisfy the above you will be able to apply for a 186.
Please note these changes apply to 482 visas holders under the medium and short term occupation lists. The changes do not apply to those sponsored under a labour agreement. Those sponsored under a labour agreement will have to transition in line with the terms of the labour agreement.
